What this is
Daily Rise is a personal wellness tool operated by John A. Liddy, D.C., 23355 Califa St., Woodland Hills, CA 91367 ("we," "us," "our"). It's designed to help you check in with yourself, try on different perspectives, and notice what shifts. It is not therapy, medical advice, or a substitute for professional mental health care.
Eligibility
You must be at least 13 years old to use Daily Rise. By using the service, you represent that you meet this age requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.
Using Daily Rise
You can use Daily Rise without an account. If you create an account, you agree to provide accurate information and keep your login credentials secure. You're responsible for all activity under your account.
Your content
Everything you write in Daily Rise — your intentions, beliefs, reflections, and boat log entries — belongs to you. We don't claim ownership of your content. We store it only to provide the service to you.
Our intellectual property
The Daily Rise platform — including its design, text, processes, code, and structure — is owned by John A. Liddy, D.C. and protected by copyright and other intellectual property laws. You may use the service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from the platform without our written permission.
Not medical advice
Daily Rise is a self-reflection tool based on general wellness principles. It is not a medical device, not a diagnostic tool, and not a replacement for professional help. If you're experiencing a mental health crisis, please contact a mental health professional or call 988 (Suicide and Crisis Lifeline).
Availability
We do our best to keep Daily Rise available, but we can't guarantee uninterrupted service. We may update, modify, or discontinue features at any time.
Termination
You may stop using Daily Rise at any time. If you have an account, you may request deletion by contacting us. We may suspend or terminate your access if you violate these terms or use the service in a way that could harm others or our infrastructure. Upon termination, your right to use the service ends, but provisions that by their nature should survive (such as limitation of liability) will continue to apply.
Privacy
Your use of Daily Rise is also governed by our Privacy Policy, which describes how we handle your data.
Limitation of liability
Daily Rise is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to emotional distress, data loss, or service interruptions. Our total liability to you for any claim arising from these terms or the service shall not exceed the amount you paid us in the twelve months preceding the claim (or $100, whichever is less).
Indemnification
You agree to indemnify and hold harmless John A. Liddy, D.C., its officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service or your violation of these terms.
Dispute resolution
If a dispute arises, we encourage you to contact us first at DailyRise@babymilestonetracker.com so we can try to resolve it informally. If we can't reach a resolution within 30 days, either party may pursue binding arbitration administered under the rules of the American Arbitration Association. Any arbitration will be conducted on an individual basis — class actions and class arbitrations are not permitted.
Governing law
These terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles.
Changes
We may update these terms from time to time. When we do, we will update the date at the top and post the revised version here. For material changes, we will notify account holders by email. Continued use of Daily Rise after changes constitutes acceptance of the new terms.
General
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force. These terms, together with our Privacy Policy, constitute the entire agreement between you and John A. Liddy, D.C. regarding your use of the service. Our failure to enforce any right or provision does not waive that right or provision.
